By booking your session, you agree to the terms and conditions outlined below:

Terms & Conditions (Rev. 05/05/26)

1. AGREEMENT
This Agreement is entered into between Yancy Villatoro Photography, LLC (“YVP”) and the undersigned Client. By booking a session, Client acknowledges that they have read, understood, and agreed to all terms outlined herein.

2. RETAINER & PAYMENT
A non-refundable retainer is required to secure the session date and time. The remaining balance is due on or before the session date.
Failure to remit payment as agreed may result in cancellation of services without refund of the retainer.
In the event Yancy Villatoro Photography, LLC is unable to perform services due to illness, emergency, or circumstances beyond control, liability is limited to a full refund of all payments received.

3. RESCHEDULING
Client may request to reschedule the session with a minimum of forty-eight (48) hours’ notice. A rescheduling fee of $50.00 will apply.
All sessions must be rescheduled within twelve (12) months of the original booking date. Failure to do so will result in forfeiture of the retainer.

4. LATENESS, WAIT TIME & CANCELLATION
Client is granted a fifteen (15) minute grace period. After such time, a $50.00 late fee will apply.
If Client arrives more than thirty (30) minutes late, the session may be canceled at the discretion of Yancy Villatoro Photography, LLC, and all payments made shall be forfeited.
If Client requests the Photographer to wait beyond the scheduled session time, a $75.00 wait fee per fifteen (15) minute increment will apply and is subject to Photographer availability.

5. TRAVEL
Travel within a thirty (30) minute radius of zip code 77433 is included. Additional travel will incur a fee to be disclosed prior to booking.

6. DELIVERY & TURNAROUND
Yancy Villatoro Photography, LLC shall deliver a proofing gallery within five (5) business days of the session.
Client shall select final images included in their package from the proofing gallery. Additional images may be purchased at a rate of $65.00 per image.
Proofing galleries are provided for viewing and selection purposes only and are delivered with visible watermarks. These images may not be downloaded, reproduced, screen captured, altered, or shared in any form. Any attempt to remove, alter, or obscure the watermark is strictly prohibited.
RAW or unedited images are not for sale and are not included in any package under any circumstances.
Final edited images shall be delivered within twenty-five (25) business days following Client’s submission of selections.
Expedited editing services are available, with a turnaround time of three (3) to five (5) business days, at a rate of $50.00 per image.

7. EDITING & ARTISTIC DISCRETION
Client acknowledges that Yancy Villatoro Photography, LLC retains full creative control over the editing, retouching, and final presentation of all images.
Standard retouching includes minor blemish removal, skin smoothing, stray hair cleanup, and light body contouring. Additional retouching requests may incur additional fees.

8. IMAGE INTEGRITY, ALTERATION & AI RESTRICTIONS
All images delivered by Yancy Villatoro Photography, LLC constitute final, copyrighted works and are intended to represent the Photographer’s artistic vision and professional standards.
8.1 No Alterations
Client shall not alter, edit, or modify the images in any manner, including but not limited to filters, presets, color adjustments, retouching, body modification, or composition changes that materially affect the original work.
8.2 Artificial Intelligence Restrictions
Client shall not upload, submit, or otherwise use any images in artificial intelligence (AI) platforms or software—including but not limited to ChatGPT, Midjourney, or Adobe Firefly—for the purpose of generating, altering, enhancing, or creating derivative works without prior written consent from Yancy Villatoro Photography, LLC.
8.3 Attribution & Representation
Client shall not publish, distribute, or display altered versions of the images in a manner that suggests they are original works of Yancy Villatoro Photography, LLC.
8.4 Breach & Remedies
Any violation of this section shall constitute a material breach of this Agreement and may result in immediate termination of Client’s license to use the images. Yancy Villatoro Photography, LLC reserves the right to pursue legal remedies, including damages and injunctive relief.

9. COPYRIGHT & LICENSE
All images remain the sole and exclusive intellectual property of Yancy Villatoro Photography, LLC.
Client is granted a non-transferable, non-exclusive license for personal use only, including printing and sharing on personal platforms.
Client shall not sell, license, or use images for commercial purposes without prior written consent.

10. MODEL RELEASE & SOCIAL MEDIA USE
Client grants Yancy Villatoro Photography, LLC the irrevocable right to use images for portfolio, marketing, advertising, editorial, social media, and promotional purposes.
Photographer agrees to exercise reasonable discretion when sharing images publicly.

11. FILE STORAGE & LIABILITY
Yancy Villatoro Photography, LLC is not responsible for long-term storage of digital files. Client is solely responsible for backing up all delivered images.

12. LIABILITY WAIVER
Client agrees to release, indemnify, and hold harmless Yancy Villatoro Photography, LLC from any and all claims, damages, or liabilities arising from participation in the photography session, including but not limited to injury, property damage, loss, or death.

13. FORCE MAJEURE
Yancy Villatoro Photography, LLC shall not be held liable for failure to perform services due to events beyond reasonable control.

14. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Texas.

15. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between Client and Yancy Villatoro Photography, LLC and supersedes all prior discussions.

16. ACCEPTANCE
By booking a session, Client acknowledges acceptance of all terms outlined in this Agreement.
